Wage and Hour Disputes Attorneys in Lubbock, Abilene, San Angeleo, Killeen, Waco, TX

Under the Fair Labor Standards Act (FSLA), as of July 2009 employers are required to pay employees a minimum wage of $7.25 per hour. The FLSA also requires employers to pay their employees "time-and-a-half" for all hours worked in excess of 40 hours in a work week. It also generally prohibits the employment of minors. Most employers are covered by the FLSA, but many employers try to avoid paying overtime compensation through these means:

Practice Areas

  • Having employees work "off the clock"
  • Using a time-keeping system that automatically clocks out employees for lunch periods or at the end of the day, regardless of whether these employees continue working
  • Requiring employees to arrive early to perform necessary preparations for the work day but not allowing them to clock in
  • Altering employees' time sheets
  • Denying employees overtime pay that management has not approved
  • Paying employees their regular hourly rates for overtime work
  • Carrying over overtime hours from one week to the next
  • Giving employees "comp time" instead of overtime
  • Incorrectly classifying employees as independent contractors
  • Switching employees from hourly to salaried
  • Misclassifying employees as "exempt"

Any claim for unpaid wages must be filed within two years (or three years if your employer "willfully" violated the law). If you have to file a lawsuit to recover unpaid wages, the law entitles you to your unpaid wages, an equal amount of money in liquidated damages and your attorneys' fees.

Moore & Associates also handles cases involving equal pay and recovery of wrongly denied employee benefits, including ERISA.
